Reasons why a wife should divide property when her husband cheats.

Recently, race car driver Seo Ju-won expressed his strong emotions towards his ex-wife, YouTuber and entrepreneur A-oi, as their divorce lawsuit revealed that A-oi was entitled to half of Seo Ju-won’s assets due to insufficient evidence of infidelity. A-oi had previously claimed on her YouTube channel in January 2023 that their marriage fell apart due to Seo Ju-won’s infidelity.

On the 20th, a video titled ‘The Glorious Life of Icon A-oi from Heart Signal Revealed’ was posted on the Studio Sujay YouTube channel, where A-oi opened up about the divorce process. In the video, A-oi revealed that she met Seo Ju-won through panelists Shin Dong and Kim Ina’s introduction, and they had a formal engagement after just 3 months of knowing each other.

A-oi mentioned that the decisive moment to divorce was when “a new person came into the picture. And that person really wanted it.” She also shared her honest feelings about losing the lawsuit involving an affair. The Daegu Family Court’s 3rd Division ruled against A-oi’s claim for damages and ordered her to bear the legal costs, siding with Seo Ju-won.

Moreover, the court highlighted that A-oi, who had not yet divorced Seo Ju-won, had sent a detailed property division agreement through her lawyer in March 2022. However, the evidence she submitted was deemed insufficient to prove the breakdown of her marriage with Seo Ju-won due to the actions of another individual.

A-oi admitted to dividing half of her assets through the property division process, stating that the cost of divorce was higher than the cost of marriage. She emphasized that despite the other party’s significant demands, she could not give more than what she had. A-oi argued that by combining their assets and splitting them in half, she essentially gave up half of her own assets.

According to legal experts, a cheating spouse can demand a substantial share of property even without direct evidence of infidelity. Lawyer Han Seung-mi of the law firm Seungwon explained on her YouTube channel that property division focuses on rewarding the individual who contributed significantly to the accumulation of assets, allowing even a cheating spouse who earned a lot of money to receive a large portion of the property division.
